1. Acknowledgement and Acceptance

1.1. These Terms of Use (“Terms”) govern your use of the Burnout Checker mobile application (“App”,      “we”, “us”, “our”). By downloading, installing, or using the App, you confirm that you have read and accepted these Terms and our Privacy Policy.

1.2. You must accept these Terms to use the App. If you do not agree, you must not access or use the App.

1.3. We may update these Terms periodically. If we make material changes, we will notify you in the App. Continued use after an update signifies your acceptance of the revised Terms.

2. Intended Use

2.1. Burnout Checker is a self-guided wellness tool designed to help users reflect on patterns of stress and burnout. It provides personal insights based on user responses to non-clinical check-ins.

 

2.2. The App is not intended for children or minors. You must be 16 years or older to use Burnout Checker.

 

2.3. The App is not connected to healthcare services, does not store data externally, and is not monitored by medical professionals.

3. Not Medical Advice

​

3.1. The App does not provide professional, clinical, psychological, or medical advice. It is for informational and educational purposes only.

 

3.2. No part of the App constitutes diagnosis, treatment, or a substitute for medical or mental health advice from a qualified professional.

 

3.3. You should always consult a licensed practitioner for support regarding stress, health, or wellbeing.

4. Crisis Disclaimer

4.1. Burnout Checker is not a crisis service. If you are in distress, at risk of harm, or in an emergency situation, please seek immediate support from a professional or emergency service.

5. Content Warnings

 

5.1. Some questions or feedback within the App may involve reflections on fatigue, emotional wellbeing, or psychological strain. While these are intended to support self-awareness, they may cause discomfort for some users.

 

5.2. If you find any part of the App distressing, we recommend taking a break or discussing your feelings with a trusted person or professional.

6. Reminder Functionality

 

6.1. The App includes optional daily or weekly reminder notifications, which users can toggle on or off in the settings.

 

6.2. Notifications are managed by your device’s local system. Burnout Checker does not collect or store reminder settings externally.

 

6.3. You are responsible for setting and managing your own reminders. We are not responsible if you miss a reminder or if reminders fail to appear due to system, settings, or device limitations.

7. Technical Limitations

 

7.1. The App operates entirely offline. As such, features like notifications, local data storage, or functionality may be affected by:

  • Device settings

  • Operating system updates

  • Power-saving modes

  • Third-party apps

  • Hardware limitations
     

7.2. While we strive to maintain reliability, we cannot guarantee the App will always operate error-free or without interruption.

 

7.3. You are responsible for backing up or exporting your data if needed. We are not responsible for lost data, corrupted files, or device-level failures.

 

 

8. Limitation of Liability

 

8.1. To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding the App's performance, accuracy, or suitability.

 

8.2. Use of the App is entirely at your own risk. We do not guarantee the accuracy, reliability, completeness, or outcome of any information provided.

 

8.3. Except for liability under your Non-Excludable Rights (see below), we are not liable for any loss or damage (including indirect, incidental, special or consequential loss) resulting from:

  • Your use of or inability to use the App

  • Reliance on any content in the App

  • Technical failures or notification errors

  • Data corruption or loss
     

8.4. If liability cannot be excluded under the Australian Consumer Law, our liability is limited to:

  • Re-supply of the App or

  • The cost of having the App supplied again

 

9. Australian Consumer Law and Your Rights

 

9.1. Nothing in these Terms excludes or modifies your rights under the Competition and Consumer Act 2010 (Cth) and any other applicable law which cannot be excluded or changed by agreement (“Non-Excludable Rights”).

10. Intellectual Property

10.1. All content, branding, source code, graphics, design, and layout of the App are the property of Burnout Checker™ and protected by intellectual property laws, including copyright under the Copyright Act 1968 (Cth).

10.2. You may only use the App for personal, non-commercial purposes. You may not copy, reverse-engineer, distribute, or publish any part of the App without express permission, unless permitted by law.

11. Updates and Maintenance

​

11.1. We may release updates to fix bugs, improve functionality, or make design changes. These may be installed automatically or manually depending on your device settings.

11.2. We do not guarantee the App will always remain available or unchanged. We may remove or alter features at any time.

12. External Content

​

12.1. The App may contain links to external websites or resources. These are provided for informational purposes only.

​

12.2. We are not responsible for the content, accuracy, or practices of any third-party site or service. Use external links at your own risk.

13. Termination

​

13.1. You may stop using the App at any time by deleting it from your device.

​

13.2. We may suspend or restrict access to the App if we reasonably believe you are misusing it or breaching these Terms.

14. Governing Law

​

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the jurisdiction of the courts in Victoria for any dispute related to the App or these Terms.
